    1. Use your own insurance, if you don’t have comp or coll I’ve never seen a worse case of S.O.L.

      ATVs don’t have insurance. Usually you file
      HO’s but with the cops/death involved file with yours.

      Highly recommended. Hopefully you have first party coverage

    3. As others have said you should file on your own. Depending on the state there may also be a crime victim relief fund you can try and collect from (good luck though.)

    4. Not a good situation for you (worse for the ATV rider). Even if the ATV rider carried liability insurance, running from the cops likely means no coverage. Hopefully you have collision insurance. If you don’t, you’re going to have to sue the estate of the ATV rider, and my guess is that won’t help you. Try to get the ATV insurance info and make a claim. You never know, but don’t get your hopes up.

    5. Long time adjuster / large loss claims manager here. Sorry, what a pain. Agree with the others you’d be best served going through your own insurance for now. They’ll search, to the degree possible, for ways to recover what they pay in addition to your deductible. If they’re successful, they’ll pay your deductible back to you.

      Without getting in to an academic debate about the insurance he may have available, it’s correct that the ATV may have been insured. There may or may not be an exclusion on that policy for fleeing the police. My carrier’s ATV/rec vehicle policy does not, but it’s commonly included in many auto policies, so I’m sure it’s also on many rec vehicle policies. If he was fleeing the police, who knows what kind, if any insurance he may have had.

      Homeowners or renters policies may or may not cover it. There is a wide variance between companies how they handle/cover recreational vehicles, if at all.

      So all of that just to say you’re best going through your own insurance and letting them pursue reimbursement to the degree possible.

    6. Call your insurance, if you have collision coverage, maybe uninsured motorist property damage coverage (may not cover). If you don’t, just get a new car because it’s unlikely you’ll get money from anyone here ever.

      There may be a victim’s fund out there you can claim though.

    7. With a name, address, and DOB, your insurance should be able to identify if the deceased was covered by an insurance policy.
