I was a pax in a Uber that was side swiped causing me damage to 5 discs. 2 by my neck that as a tear. I had a laminectiomy with disectomy surgery two weeks ago. This entire ordeal has cost me 10 months of pain and suffering. I still have PT to attend. On anxiety meds and doing group therapy since I’m unable to drive over 2 miles. The woman has USAA and we have the same insurance. We also have a lawyer. The ambulance drive and the first ER visit was 12k the day it happened. USAA wanted to settle before the surgery but wanted to wait. How much would be a good settlement? This accident has put us in a hole since my husband needs to take day off from work for Dr appointments and therapy. missing work.

No one can answer this. Every case is different. Wait till you’re done with treatment especially with surgery being involved.

You also have a lawyer. Ask them.

The amount of people who have attorneys but still ask us for value is wild to me. There are a million factors that go into evaluating your claim and no one here can tell you what it’s worth. Surgery adds value but then again, Uber has a high policy limit and money they can spend on experts to confirm if you needed the surgery because of the accident or if you had pre-existing conditions. Your attorney should be giving you an idea on value and if they don’t, that tells me they don’t know if Uber is actually going to accept all your treatment as reasonable.

      My condolences.

For reference: it took me “years” to recover from disectomy surgery, and I still have residual symptoms. So don’t settle soon. See what happens.
