It was never really in effect because the FTC simply does not have the power to do this. I mean, his heart is in the right spot, but Congress would need to act here.
Also, when republicans complain about agencies broadening out their power to enact all sorts of things outside of their scope, this is a really really good example of that actually happening.
Non competes are mostly already regulated on the state level, there’s some states where you can write all sorts of crazy shit in to one, and some states where they’re effectively fully banned, and everything in between.
