On September 8, a person backed into my car in a parking lot. I know who it is and she refuses to give me her insurance information. She insisted that she'd pay for the damage. The damage is $1527. She paid me $200 and then said she lost her job and totaled her car so she can't pay any more. She still won't give me her insurance. I went to the police and they were useless. I was told that because I waited more than 10 days to report it, it was too late. Also, they wouldn't do anything anyway because the incident happened on private property, so it's a civil case. I asked if they could get the insurance information and they said they can, but they can't give it to me because it's a civil case.
So, their recommendation is to put it through my insurance (Liberty Mutual) and let them go after her insurance. The problem I have with that is that I've already had 2 claims this year – a windshield replacement when a town dump truck coming the other direction threw a stone into my windshield and a deer hit. Although none of these are supposed to count against me, I'm sure they all do. Since Liberty Mutual basically has no agents, there isn't anyone I can get direction from with the company. I've reached out to a couple of "agents" that work for the Liberty Mutual subsidiary, but they won't talk to me because I'm not assigned to them.
The other recommendation is to pay for it and take her to small claims court. I can do that, but all that will get me is a judgement and she still won't pay. I don't see any way I'm going to see the money or get her insurance to pay. She's 18 and lives with her grandparents and is on their insurance. I've reached out to her grandfather and he refuses to talk to me.
Any other suggestions?
