I'm in CA and I have GEICO for car insurance.

    Before my policy was set to auto-renew, I received a letter and a text from Geico asking me to update my driver's license info. I provided the info 20 days before the renewal date and again verified it over the phone about 10 days before.

    Geico let the coverage lapse. As soon as I realized I had been driving without insurance, I contacted Geico, and they are expediting the underwriting process so I should have insurance again in a day or two.

    They aren't willing to provide any refund or credit because they said my insurance will cover the previous 3 days. I've missed work and other obligations today because I didn't have car insurance. The agent said I can drive during the underwriting process, but I don't feel like that is correct.

    Questions:

    1. Is it legal for me to drive in this circumstance?

    2. Is there anything I can do to attempt to recoup a credit or at the least an apology? When asked why this happened, the agent said something about, sometimes policies go to underwriting if the required info isn't provided in time, but I gave the info 20 days before the policy was set to renew.

      If the carrier makes a mistake, they will always reinstate with no lapse. This essentially means the cancellation never happened so, yes, you are legal to drive. There is no refund or credit due. You still have to pay for the days they provided coverage. If you get a refund, that would likely mean your policy is cancelled.
