So I was at a mall last week, and as I was pulling out from the parking lot and I got hit from the side. The other driver took off but I was able to get her license information and I reported it to the insurance. But my insurance said I was "at-fault" for this and they added it to my record. Has anyone been in a similar situation before?

    Got into an accident. The other driver took off but I still got "at-fault" on my record.

      Whenever you are pulling out of somewhere (whether its a parking spot or driveway), you don’t have the right of way. You are responsible to make sure traffic is clear before you pull out. The “pulling out” driver is almost universally going to be found at fault.

    2. if your pulling out from a parking space and someone hits you, your at fault.

      if your leaving the lot and joining a public road, usually the public road has right of way (assuming no traffic signals/signs).

      if you were just driving through the lot to leave and you two made contact, both parties will just deny fault and pay their ends.

      My actual assumption is if they just took off without hesitation, they probably had no insurance or invalid tags to begin with.
