Hi,

I’m kind of very confused on my current Homeowners claim and have no idea what to do really at this point. My Insurance is Allstate and they have made like everything worse since the start, and like my claim is on full security lockdown, so whenever I call the 1-800 number, no info can be given, and my adjusters stopped responding to me. I made multiple posts about this and everyone is saying I’m not giving the full story and stuff which is why I want to try and clarify more.

It was a Category 3 water claim from a clogged toilet. It got basically everywhere in the house, I cut off the water, called mitigation company, etc. A lot of my family got sick during the first week from it so I paid out of Pocket for hotel’s and what not because they denied ALE, because “odor’s don’t constitute ALE.” I told them that I wanted an IEP (Indoor Environmental Professional) when mitigation was over and also I made a DOI complaint. The day after I informed them I wanted an IEP and made a DOI complaint, I am under SIU and have to do an EUO. They also told me that mitigation was completely successfully from their review in regard to the IEP concerns.

I don’t understand because like they said the reason they also wanted the EUO / SIU is because they never had a recorded statement, but I gave them recorded videos of the water/feces everywhere, and their field adjuster came out saw it herself. Also like they covered the claim at the very start in writing, and then just out of nowhere went back on it.

The day after the DOI asked them to respond & my request for an IEP, they did the above request of an SIU/EUO. Also they wanted to send out an engineer and American Leak detection. I don’t really understand the above aspect, I hired my own engineer who was bewildered at Allstate’s request, due to the fact of the video I had showing feces everywhere/water, and that I was on a slab foundation etc. When the engineer Allstate sent out came, he was asking me questions and what not, than I showed him the Video, and he was super concerned at that point as well, and I was to as to why Allstate didn’t inform/supply their engineer with that Video. The biggest concern that I have is that they started the SIU after they already confirmed the covered peril/mitigation, multiple people have informed me that without that Video, it would have been impossible to truly confirm the caused peril, because all the damage was removed. The engineer from Allstate obviously couldn’t tell me too much and what not, but I don’t know a week later they dropped the EUO/SIU.

I am just like very concerned on so much stuff and don’t know what to do because like throughout this entire claim they’ve constantly been leveraging/pressuring me. They got so angry at me when I told them I was going to use my own mitigation company/Pack-out company, that they issued a Reservation of Rights letter forcing me to provide proof of mitigating all of the house/clothes in less than 3 days, or the entire claim would get denied a day after the claim. During the SIU/EUO, I paid the mitigation company out of pocket, and they forwarded/showed me all the emails/communication showing that Allstate was leveraging/guiding the work. The contractor Allstate sent out informed me that the estimate he wrote for the damages were severe, however Allstate sent him a revised estimate, and he signed it due to the fact that he doesn’t need to do the work for that amount and still gets paid by Allstate to sign off. They kept pressuring me to sign there Pack-Out company’s Work Authorization, but the only thing that I didn’t understand is the Pack-out company told me that they don’t control the cleaning, Allstate does. Allstate further informed me that I lose all rights to the appraisal clause if I don’t sign, and that if I didn’t sign they were going to deny my claim.

I don’t know what to do, the day they dropped the EUO/SIU, they sent out some checks, but they were bad checks with the wrong name and can’t be cashed. I spent out of Pocket on this claim so far like $70,000 on ALE/Mitigation/Engineers/IEP, and they keep just ignoring me for reimbursement. They aren’t responding to any of my emails and the manager’s aren’t responding either. It’s on full security lockdown, so no one from the 1-800 number can help either. I don’t really know what to do at this point, I contacted lawyers but Allstate hasn’t provided any denial letter’s, so they said that I can’t pursue if they haven’t denied anything, and the DOI said they cannot force the Insurance company to do anything. Is there anything I can literally do… they won’t fix their checks, reimburse me, or like even respond to me, and I’m like so lost at this point since their full on ignoring all my emails/communication.

if anyone has been in this situation please let me know what I can do, thanks so much!

    1. You are out $70,000 for a clogged toilet that you immediately turned the water off to? Story makes no sense.
