I got into a accident on December 31st. I slowing my car down at a red light when I hydroplane going at 5 to 7mph. I turn to the right and clip the guys back bumper. It was a simple Crack on the bumper. The guy drives a independent taxi company car. I pulled over and exchanged information. I asked him if he needs a ambulance or a file a police report he said no. Im fine. Your fine. I told him i can pay for the damages on the vehicle since its a toyota prius from 2010s. He didn't respond. He wnet on his way. I called my insurance company to report the incident. I found out my insurance lapsed. I paid that same day over the phone once I found out. Fast forward to Thursday. I find out that the guy got a personal injury lawyer and is trying to sue me. He filed a claim thru my insurance. I called the guy handling my case and explained my situation. I told him I dont have any money saved up and I am in debt. I dont have any any thing to my name. What do I do?

      It doesn’t sound like you’re being sued. Having an attorney doesn’t mean lawsuit. Your insurance will evaluate his claim and work with his attorney to resolve it. CA is incredibly litigious, I wouldn’t stress over it.

      Do you have coverage on the date of the accident?

      If yes, you don’t have to do anything. Your insurance company will handle all of it, including the attorney.

      If not, this really isn’t an insurance question. There’s no insurance involved. It’s a legal question, or personal finance question. We’re not really qualified to comment.

      I know this is really stressful. I hope things calm down soon.

      You have nothing to worry about since you have no assets. They will file through their carrier and open UMBI claim. Since you are uninsured they may waive his deductible. Worst thing they can do is put you in collections.

    4. I am assuming you own the car you were driving. Once, the personal injury attorney realizes there is no money, they will drop the case.

      Get a letter from your insurance company stating your insurance waa cancelled and no coverage was in effect the date of the loss. The attorney will quickly disappear. Heck, the attorney may have already reached out to your insurance and found this out. Now an SR-22 may have been filed as a result of the accident if so, you will need to file in response. As far as the property damage goes, work only with the cab company. As you said, this is not his car, so not his decision to fix or not and not his money to fix it.
