Hi, I was rear ended and I just found out that the person that rear ended me didn’t have coverage. I’m going through my insurance to settle the portion of my vehicle which was a total loss. Once I get paid for my repairs, my adjuster will file a subrogation claim. Can they go after her even though she didn’t have insurance? Will I get my deductible back and my rental car reimbursement? I also did some deep research on this person and found out her and her husband have some sort of vehicle tag registration service.

    1. Yeah, they can still go after her. Subrogation is against the at fault driver directly, not just their insurance company.

      The realistic part is collection. If she has no insurance and no money, recovery can be slow or never happen. If she does have assets or income, your carrier can pursue her, send it to collections, or sue depending on the amount and the state.

      You only get your deductible back if your insurance actually recovers money from her. Same deal for rental. If you have rental coverage on your policy, your carrier pays it now up to your limits. If you don’t, you usually only get rental money back if they recover it later.

      That tag registration business might matter if it means they have attachable income or assets, but it doesn’t change liability. It just makes recovery more likely.
