Hello,

    I’m not sure if this is the right place to ask. However, StateFarm won’t give me a straight answer about what’s going on.

    Situation: I was driving down a back road around 0430, down a steep hill, and noticed a tree had fallen across the road. I slowly approached, hoping that I could just move it and be on my way. As I got closer, I noticed the tree had pulled a power line down and it was now suspended by that line. I immediately backed up 500m or so and turned on my hazards. I called the non-emergency number and explained. As I was on the phone, a truck, driving the opposite direction, came flying around the corner and hit the tree. I immediately stepped out and yelled to see if they were okay and warn them about the power line. The driver then drove up to me and waited for the police and fire to arrive. The driver asked for my name and number in case.

    Issue: I received a text from StateFarm that “my claim” had been initiated. I am not a customer with them and I DID NOT file a claim with them. The other driver made a comment about MY lights blinding him when he came around the corner so he couldn’t see the tree. Can I be found at fault?

    Based on what I witnessed, I believe he was texting or not paying attention. The tree was easily visible from the top and bottom of the hill and large enough that it would be nearly impossible to miss.

    Overall, I reached out to StateFarm and the adjuster wont call me back or answer the phone. I was able to speak with an agent who refused to give me any more information other than “it is listed as an accident with a tree”.

    1. You’re not going to get much info about the claim as you weren’t directly involved. It’s likely his insurance already found him at fault as it’s a single vehicle loss (accident) with a tree. Hitting a stationary object is 100% on the driver.
