We’ve been under contract for coming up on two weeks. My realtor texted us today saying the seller wants to back out because it is “too stressful for him”. I know we don’t legally have to let him out of contract, but he is also allowed to not negotiate repairs or adjust price based on appraisal – ultimately forcing us to back out so that we aren’t getting a bad deal. We have already had an inspection and I ordered and paid for the appraisal yesterday. My realtor says I will get my earnest money back and probably my appraisal money back, but not my inspection money. What can I do here? Thanks in advance

      I’d have your realtor deliver the message that you’ll forgo a lawsuit for “specific performance” if the seller reimburses you for the appraisal fee (in addition to your earnest money return of course).

      Get all the money you spent from seller up front, then allow cancel and return of deposit.

      No point in forcing it with lawyers etc and delaying a year.

      Is he really stressed out or did he get a higher offer and now wants to get rid of yours? That’s what I’d be asking.

    5. So they will just say: Take it or leave it, fixed price and as seen – no further discussions, no contingencies, no reductions for anything, no repairs. THAT is what you can force to get.

      You’re right that the seller can make it so difficult that they’ll try to force you out of the transaction. If they truly want to cancel, and you’re willing to go find another property, I would seek reimbursement for all of your cost costs.

      If you ordered the appraisal yesterday I can guarantee you that the appraisal wasn’t completed in 1 day… The first thing that you need to do is to Cancel the appraisal. You need to cancel any further expenses related to aquiring this property.

      2nd of all FIND A NEW PROPERTY!!! THERE ARE HUNDREDS OF PROPERTIES SITTING AROUND. GET SOMETHING ELSE
