Neighbor to property has well on what's soon to be no longer their historic family land. Wants easement. Afraid it will effect sale value. Thinking compromise like a one year easement so they can put a well in on their own property might be the way to go. They are rather entitled and can be a pita to deal with.

    What's your opinion on easements?

    1. I wouldn’t do a permanent easement, because the encumbrance would probably scare off future buyers of your land or at least complicate things.

      One year permission for construction would not be an easement. I would rent him access, $20.00 a month for one year. Since they are a pita, then you might have a lawyer write it up (and charge them for that as well.)

      Are they subdividing? How will that otherwise affect your property? Would cooperating with them give you any benefit as to property lines or services run?

      Don’t sell it cheaply……negotiate a fair market value for the land strip after confirming the easement’s exact terms in your deed

      Are you sitting on an acre? 100 acres? How large and where is the easement? So many questions

      No easememts, offer them a 1 year revocable license and have it drawn up by an attorney.
