Dec.8th 2025 I was hit while coming home from work. Police report showed it was his fault. His insurance declared my 2015 Prius a total loss and instead of offering the ACV of at least 5k, they offered 3,000 because the miles were at 210k. I argued and sent comps and tried to call for an outside appraisal but they said they were considered a 3rd party of are in Arizona so no dice. They sent me a check for 781.00 and told me that I was keeping the car. I never signed or agreed to any of it. Now I’m stuck with a car that I can’t legally drive. I’m in Texas btw. My insurance company won’t help because since I owned the vehicle, I only have liability. Is there anything I can do in this situation? Commonwealth Casualty said that they closed out my case.

      Consult a Texas bad faith insurance attorney. Many take these cases on contingency.     2. you chose to carry liability only, therefore your options are to accept their settlement or sue the driver and their insurance and win. you didnt like their value so they cut you the price to keep it basically.

      the stark reality is you have a 11 year old prius with 200k on it, how much do you really think its worth? At best id say if it were perfect and where I live near NYC (which statically has higher values on stuff) maybe 4500, probably 3500-4000
