Hi friends! Backstory here.

    I was pulling into my drive way and was rear ended by a driver with no license. I contacted his insurance company and was told by the rep he had no insurance. I file through my insurance bc my car is totaled. ( goodbye 2004 Monte Carlo ) I now get a letter in the mail saying there is insufficient evidence to support any claim of fault from his insurance.

    Not sure what to do ??? In my state police reports don’t state who is at fault, but this mfer hit me hard enough that he ended up flipping his fricken car. I’m just out of a reliable car now, and stuck with 3 grand to try and find something that isn’t a hunk of junk. Any assistance is welcomed.

    I was rear ended, and the drivers insurance deemed him not at fault. What do I do ?

      It is not up to iinsurance companies to decide who is at fault. That’s for the police and/or courts.

      Your insurance seemingly already paid you. Theres nothing for you to do at this point but get a new car.

      Did you call your insurance company to see if there was a mix up in letters? I’m sure they meant to send you a letter that there was no subrogation available.

      Regarding the car it was a 22 year old Monte Carlo. You were already driving a hunk of junk. Why cry about it???? Take your $3000 and buy another one?

      Are you sure the letter from the other insurance carrier wasn’t just telling you they have no coverage?

      Your insurance paid you out the value of your car minus your deductible, per the terms of your contract with them. You might get your deductible back if your insurer decides to subro. If not you can sue the other party in small claims court for your deductible, but collecting might be an issue. I’m curious as to his insurance denying liability, on what grounds did they make that decision.

      Your company paid you and they will then try and recover their money from his insurance company. Once you accept anything it’s pretty much over.

    7. Police nowhere in the world determine who is at fault.

      Also if he had no insurance how does his insurance company say he was not at fault?
