Hello, I put a downpayment on a patio we anticipated to have built. It was an extensive project (outdoor kitchen, outdoor fireplace, raised patio) and we put 50k down on our Amex.
We’ll fast forward, the contractors have been shitty to deal with. They’ve been ignoring our calls. They don’t respond to emails. It’s been a real challenge. The contract says
Projected Installation Date(s): Company ABC will perform the services with reasonable dispatch in a good workmanlike manner within the projections below from the final detailed measure. All installation timelines are weather permitting, and dependent upon material availability.
General Interior/Exterior Remodeling: 12-16 weeks
We had our final measurement Feb 14th. They verbally confirmed they’d be done by June so based on their expected dates in the contract it was pretty accurate. Well we don’t even have HOA approval which takes 30 days that’s required to apply for permits to even start construction.
Can I dispute this charge and what’s the likelihood Amex will side with me saying they have broken the contract for not even starting work?
