They are now acting as if that wasn’t the reason we had made our offer but did acknowledge the emails with said offer in place. We expressed that we’d only do dual agency under this contingency. They responded with “in 8 years of doing this I’ve never rebated a percentage of my commission I will speak to my broker tonight”. Anyone have experience with this is this normal? Or are they just trying to slime their way out of what they agreed to.
Went dual agency with the sellers realtor under the pretense that we’d get a 1% rebate on commission.

If it’s not in an agreement, you won’t get any rebates. I don’t use an agent for the sole reason that they just take money without doing much work
What does your written buyer broker agreement say?
This sounds fishy… be ready to go over their heads to speak directly to the broker yourself with email receipts if they tell you the broker said “no”.
Edit: Even if not in buyers agreement, if you have them talking about the offer in email, their broker may not be too happy to find out they’re being slimy and making false promises.
If you have a written agreement, then you might have a case. If not, you are probably SOL. You always have the option to file a formal complaint with the provincial regulator as well.
You need to go back and look at the buyer representation agreement. This is where you are, in writing, agreeing to pay the agent a certain amount. Now, usually, the buyer representation agreement will state that it may or may not be offset by whatever the seller is contributing. But any rebate that you have an expectation to get needs to be in that agreement.
Sounds like they didn’t agree.
Real estate runs on written agreements. There are states where you can make arguments based on texts and emails, but these things should never be considered settled until their own paper with the signature of all parties
Do buyers not understand how insulting asking sellers for rebates is to the seller? “Pay me to buy your house” is not a rational offer to anyone except you, the buyer.
How did you get the impression you’d get a rebate? From a marketing ad or email not related to the transaction?
