My 2009 Infiniti G37x was hit by another driver. Not my fault. Minor door damage. Progressive's own repair estimate: $3,988.
Progressive refused to repair it.
Instead, Progressive declared it a total loss — using condition ratings in their valuation report that their own repair estimate contradicts on six separate points. The same inspection. The same vehicle. The same day. Two Progressive documents that cannot both be true.
The Infiniti authorized repair facility that has the vehicle assessed it as "in good condition and worth fixing." They verified progressive fabricated issues with my car that do not exist in order to lower the value below Utah law requirements to claim salvage title.
Progressive's own comparable vehicles were listed at $8,998 and $7,495. After applying condition deductions contradicted by their own documents, my vehicle was valued at $5,299 — precisely the amount needed under Utah law to justify a total loss declaration.
When I disputed this in writing, cited specific Utah statutes, and filed a formal complaint with the Utah Insurance Division (Complaint ID: 90094), Progressive sent me an unsolicited payment and referenced DMV salvage title action — while the complaint was actively open and I had rejected all settlement offers in writing.
I filed in small claims court. Progressive retained Jones Skelton & Hochuli — a large defense law firm — and moved the case to Utah Third District Court (Case No. 268400379).
They are spending more on attorneys than the cost of the repair.
I am personally aware of others who have experienced similar outcomes with Progressive — total loss declarations they felt did not accurately reflect their vehicle's condition or market value.
If any of this sounds familiar I want to hear from you. Specifically:
-Did Progressive declare your vehicle a total loss using Mitchell WorkCenter Total Loss software?
-Did your valuation show condition deductions you felt were inaccurate?
-Was your total loss valuation significantly below what you believed your vehicle was worth?
-Did Progressive send you unsolicited payment or reference DMV action while you were disputing the claim?
Utah Insurance Division complaint ID 90094 is active. This case is on public record. I am looking to connect with others who have had similar experiences.
All statements are based on documented evidence in public court records. Case No. 268400379, Utah Third District Court, Salt Lake City.
Progressive refused to pay for $4,000 minor repair. Instead they hired a law firm Jones Skelton & Hochuli – what are they trying to hide?!
