Drive Uber full time. I was in a hit and run accident 1.5 months ago while driving for Uber with an active trip. Official police report shows no contributing action on my part and the other driver caused the crash and fled.

    Other driver has been identified via License Plate, he filed it stolen with his insurance (Allstate). Found his car online, totaled at a local salvage yard — not sure if that hurts or helps his stolen vehicle defense, or if that was his doing or just the insurance selling it for scrap.

    I have two options:

    Proceed through Uber's insurer — pay $2,500 deductible, they subrogate Allstate, possible deductible refund later. No lost wages covered.

    Pursue Allstate directly — no deductible, lost wages potentially recoverable (probably not though? Not really sure), but recorded statement risk and longer timeline.

    No dashcam available. Left turn on green involved. Comparative negligence state.

    What path of action do you recommend given your experience in insurance.

    Hit and run while driving Uber: pursue other driver's insurance directly or go through Uber's insurer?
