I was recently in an accident where two idiots were racing on the freeway, hit each other, and then one hit me. I was rear-ended and spun counterclockwise, and then grazed again by the same idiot and overcorrected to go back clockwise and end up straight on the road.
State Farm, my insurance, is denying that the left front bumper damage is from the same incident, with the adjuster stating something to the effect of "the damage is too minor to have come from such a severe accident". There was no damage to the front of my car prior to the accident, and now there's impact marks and the headlight is cracked (very light damage when compared to the rear of my car, which basically sent the back of my car into the left rear tire axle). There is identical paint transfer on the rear bumper and the front bumper, which further bolsters my claim, but they don't seem to care.
The damage isn't reflected in the police report, I myself didn't notice it until later on, since the accident was at night and the lane right next to the left side of the car had active freeway traffic on it and I couldn't get close to that side of the car. I am trying to get it on the report, but CHP told me that the reports don't include all damage, and it's up to the officer. I provided a photo to State Farm of the area totally undamaged 6 months ago, but they're telling me the photo is too old.
How do I fight State Farm on this? They're basically telling me that unless I can go back in time and take a photo of my car from right before the accident, or get the damage added into the report, they're going to deduct damage from my car. This damage was NOT there prior to the accident, and 100% from the accident. Not a single part of this accident was my fault but I've had to fight my own insurance company every step of the way, and this is the latest installment of it.
