Need advice/insight from people who have gone through insurance subrogation or renter liability situations because this has become extremely stressful.
Timeline:
* End of October: I installed a simple bidet attachment in an upstairs bathroom in our rental townhouse in WA. No drilling/cutting pipes, just tee fitting + hose attachment.
* After installation there was no visible leaking or dripping . We used the bathroom normally for days.
* Nov 2: We suddenly noticed water damage/staining in the downstairs ceiling and flooring after my wife had used the upstairs bathtub the night before for our toddler’s bath. We immediately shut off water removed the bidet just in case and called landlord but I was honest about it’s installation and timelines, didn’t lie or hid anything. The lease says “I shouldn’t do any big modifications or alteration” but nothing for bidets.
* Same day landlord brought ServPro. Tons of fans/dehumidifiers installed.
* Nov 3 plumber came. Their invoice mentioned:
* leaking supply line
* leaking bidet tee fitting from another bathroom upstairs when they shut down the main one (not sure why what happened)
* damage to ceiling/subfloor
The plumber said “ i think the bidet was leaking from behind to the wall directly then going down that’s why it’s not visible???”
* Weeks later during demolition, another issue was discovered: a nail hole/problem in a drainage pipe behind the wall that was actively leaking during testing after drywall removal. That pipe later had to be cut/repaired (I made sure to get a copy of that invoice mentioning that + keeping the pipe)
* State Farm paid mitigation/demo/restoration and now says damages are around $44k.
* My renter insurance denied coverage (they said water damage is excluded from your coverage even for liability…)
* Recently State Farm contacted me directly and described the incident as a “pipe burst,” but there was never any actual pipe burst event at all and asking me for the 44k
* They are now pursuing me personally through subrogation.
* I said I will check with my lawyer and want all communications with my lawyer
* I have a lawyer who’s very slow responsive but included in a metlife legal plan with my work (covers 16 hours i believe) and he said “this has turned into a disputed causation/liability situation because there are multiple possible causes and may go to court”
Questions:
* What usually happens next in situations like this?
* Do these cases commonly settle?
* How aggressive do insurance companies usually get after denial?
* Has anyone dealt with a bidet/water damage subrogation case before?
* How worried should I realistically be about lawsuit/judgment risk?
I recently closed on a house and have kids, so this whole situation has honestly been overwhelming.
