Sorry this may be long. I'm in Kansas. A couple of days ago I was driving down a road in a construction zone. They had the right lane closed for construction so I was in the left lane going about 20mph. Out of nowhere my SUV was pushed up into the median by this huge CAT wheel construction machine. I had no warning, he literally hit the entirety of my SUV. I had no time to respond; braking, turning my wheel, nothing. I was in shock. It took me a minute to settle myself from being blind sided and I literally had to open my sunroof to talk to the operator of the machine because he sat so high up. He said he just didn't see me when he came over into my lane. The lady that was behind me stopped and she said the same thing, that he just came over and pushed my car up into the median. The operator of the machine told the same story to the police, so no issue who was at fault and my cars automatic braking system did engage either. My question is, my SUV is a 2023 Toyota Highlander Hybrid Platinum, the entirety of the passenger side is crushed. I have only had the car since November. I only buy a car once every 15 years as I buy as nice as I can afford (last car was a 2009) and drive them into the ground. I have no clue if they are going to total the car as they are still taking it apart and assessing damages. However my problem is if they do decide to fix it, it's just not the same. The car had been so jostled that the trim around the windows shook off. I do not buy cars that have been in any accidents as I feel that they have been compromised no matter how great the repair job is. And if I go to trade it in they sure are not going to give me the full value of the car. So what are my options? I have never been through this, I hope and trust my insurance agency but again have not had any claims. I don't know the laws of heavy machinery operators and I feel as their should have been someone out their directing traffic if that big machine needed to move into a lane with traffic especially if they have a blind spot that can't see a full size SUV. I just want to be made whole, nothing more nothing less. The time that this had already taken from me in a period that I don't have much to give and the angst that this has brought is already horrible. Luckily I did not sustain any horrible injuries, just sore and stiff.
