I was hit by a drunk driver in January. No fault state. For about four months I got PT, two visits to a specialist and one MRI was done in August when PT finished up. Haven’t made or planned to make any more claims on this claim.

    Today I got a letter that the claim was denied, effective the date of the accident, and the reason is because I didn’t appear at a medical examination and the date given is a date that I wasn’t even in the country. I had no notice of this medical examination.

    I’m mostly curious, what happens to the bills already paid now that the “claim is denied”. If the claim is just closed, that’s fine I don’t anticipate any more bills. But I don’t want to be held responsible for the bills that were paid out over the last six months.

    I’m also rather annoyed about this mystery medical examination that I never heard about, that was apparently scheduled weeks after my last treatment being the reason for the denial.

    1. I can’t speak to the disposition of your particular situation, but there are recovery payments when a claim is accepted for adjudication and then later denied after it was initially paid…and they aren’t terribly unusual, either.

      As for whether the patient is liable for the balance, I cannot say, but I’d be surprised if there wasn’t any that applied to the patient account.
