I had work done to my truck so my fiance could take it back home for the weekend. She was going 65 mph and the wheel flew off into on coming traffic. No one was injured thank god. We had found that the front tire lug nuts were still hand tight, and were moving on their own putting the mechanic liable. Its a blessing and a curse because no attourney will take my case. I am trying to find an attorney under property damage now in Tennessee. Is this the right route? I just learned from my insurance company is willing to total the vehicle. I am at a loss for what to do, thoughts?

      No clue on the route for you to take.

      I had a shop rag unknowingly left in my engine and they released my car to me. I drove a few miles and oil pressure light came on. They towed it back and told me what happened and then gave me a new engine all free labor and parts since it was their fault. I assume they did an insurance claim on their end for their mistake. I just know for me, I got a new engine and was out my car for a week and they covered my rental too.

      If your insurance company is totalling it out, let them do it. They have an entire dept that will handle going after the true at fault person. It’s called sub rotation. They’ll pay you and then go get paid back by the mechanics insurance or sue him. As a part of this any deductible you paid will get reimbursed if they are successful.

      No lawyer will take this because of this process and there is no money for them in PD cases.

      Additionally any legal process you initiate will take infinitely longer than just letting your company continue to handle it.
