Today I found out that my father has been taking out student loans in my name without my knowledge or consent, and I’m over $40k in debt because of it. I’ve never personally taken out any student loans before. Is it legal for a parent to take out student loans in their adult child’s name without their knowledge or consent?

What kind of loans? You can’t borrow that much in federal loans in the students lol name. Are you sure they aren’t Parent PLUS loans?
That’s fraud.
If he took loans under your name— most likely are parent plus loans— he is fully responsible to pay—- you don’t have any obligation to pay— he used his credit..
If he forged your signature— well— that’s illegal and you can take action to correct it.
Google how to check if you have student loans under your name and for what school and year..
Are the loans paying for your tuition? Are they parent plus loans? If so, they are in your father’s name.
Your father stole your identity to commit fraud. Where to go from there is your decision.

Were you under the impression the debt was in your dad’s name?
Your father committed a serious criminal act. You are the victim of that act.
