Hello everyone!

    My husband and I bought a house in June and for some reason I was never required to put my signatures. We are pretty young, did not know better, and now we just realized I am not as a co-owner. We are trying to do the quit deed claim and we are lost. We do not want to hire a lawyer since we have read in the state of Florida is an easy process.

    Can someone recommend me a good form to fill out with rights of survivorship as well as any other pro-tip you might have for us? Do we both have to go to the county clerk office to present the forms, or can my husband go by himself to add that form?

      First, don’t panic. This happens more than people think, especially with married couples.

      This isn’t really a quit claim situation the way people usually think of it. You’re not fixing a mistake, you’re just adding title the way it should’ve been done from the start.

      Florida does make this pretty straightforward, but the wording matters. You want it done as married couple with survivorship, not just your name slapped on there. That’s where people mess it up trying to DIY too fast.

      Your husband can sign, but you’ll likely both need to be involved for it to be recorded properly. One person just showing up with paperwork usually isn’t enough unless everything is already notarized correctly.

      Big thing to double check before filing anything… make sure the lender is okay with it. Some loans care, some don’t, but you don’t want surprises after the fact.

      This is very fixable. Just slow it down a bit so you don’t have to redo it later.
