While merging on the freeway I was side swiped by another car. I was infront of the vehicle that had hit me so I turned on my 4 ways and proceeded to the next exit which was less than .25 of a mile away. The person followed but last min jumped back in the freeway and kept going. I followed her 5 miles while honking and signaling to pull over. She finally pulls over and I call the cops. But the cop said it is not considered a hit and run because she is currently in front of the officer and she told the officer she didn’t want to pull over because she was scared.

    Is this considered a hit and run?

      If she is legitimately scared than that can be a defense. Perhaps she viewed you as intimidating. The officer saw it this way.

    2. Maybe, but it is not super relevant to insurance most of the time. Just hope that she is honest with insurance that she side swiped you.

    3. Could be, that would be for a judge to decide, but with her eventually stopping many cops are just going to use their discretion and not pursue it

      If you were the one merging how were you side swiped? Or did you merge ínto somebody’s front bumper?
