On December 16, 2025, I was driving northbound in the far right lane and was fully stopped at a red traffic light.
While my vehicle was stationary, the other vehicle exited the parking lot on the west side. As the other driver attempted to turn and merge into the far right northbound lane, they struck the driver’s side door of my vehicle with the front bumper of their vehicle.
Again, My vehicle was not moving at the time of impact and there were no evasive actions available to me due to being stopped at a red light.
I filed through the other drivers insurance and today I was told that they have decided 50/50 liability! This is ridiculous. What do i do? I’ve never been in an accident before.

Your absolute best bet is to file through your own carrier if you have collision coverage, and then let them worry about pursuing the other insurance. Sure, you’ll have to pay your deductible, but you may get that back through subrogation.
If you don’t have collision coverage, then you had better have some sort of proof in the form of video or independent witness statements. The other driver is apparently saying something that leads their insurance company to believe there’s shared fault, and unfortunately, the burden is entirely on you to prove otherwise. Good luck.
You have two resources 1) submit video evidence showing fault of the other driver 2).submit a police report showing fault of the other driver. Basically appeal with evidence. Otherwise it is their determination and it really is their way of deferring cost back on you.
I guess my first question is, why have they placed 50% liability on you when you were stopped in the roadway and this person exited a parking lot and struck your vehicle?
Use your insurance or sue the driver and win in court.
