When we viewed the home there was still a decent amount of personal property present.

    The home belongs to an older couple that I believe is downsizing. We want to present the opportunity for the sellers to take any of the items they want with them, but whatever they don't want they can leave behind and we will take responsibility for. This will potentially alleviate some burden for them and give us a leg up on furnishing the space. We do not want them to, for example, bring over junk from family and friends that is tough to dispose of and that then become our responsibility, but we are willing to take responsibility for everything we saw during the showing should they choose to leave it behind. What would be the best way to word this in our purchase agreement to entice the sellers but leave no room for misunderstanding or manipulation?

      Honestly I’d just add a clause like “Sellers may leave any personal property that was present during initial showing on [date], buyer accepts responsibility for disposal/removal of said items. No additional personal property may be added after this agreement.” Keeps it simple and covers your bases without getting too wordy

    2. Property to be left broom clean.

      Please take a look at your standard local contracts. You may find this type of issue already addressed.

    3. You need to itemize the specific items you want them to leave behind. Do leave anything to”good faith.” Anything not listed is their responsibility to remove. You can add pics as an exhibit of those items.

      Seller may convey any and up to all personal property that was present during showing.

      Personal Property and Seller Removal

      Seller may, at Seller’s sole discretion, remove any and all personal property currently located on the Property as of the Buyer’s initial showing on [date]. Any personal property present at the time of Buyer’s initial showing and remaining on the Property at the time of possession shall be deemed abandoned and shall become the property and responsibility of Buyer, at no cost to Seller.

      Seller agrees that no additional personal property shall be brought onto the Property after the Buyer’s initial showing for the purpose of abandonment, storage, or disposal.

      Limitation on Additional Items

      Buyer’s acceptance of remaining personal property is expressly limited to items visible and present during the Buyer’s initial showing. Buyer shall have no obligation to accept, remove, or dispose of any items introduced to the Property after that date.
