Hello! I’m 25, Male, living in Chicago. I wanted to know how I should go about this auto accident that happened yesterday.

It was 6:30am, and I was driving in the right lane, while the other driver was in the left lane. They merged into my lane during an intersection, and swiped my car’s left mirror, and did some damage to my car. It’s mostly cosmetic and paint, but unsure how I should go about this. My deductible is $500, and it’s leased. We exchanged information, and I filed a police report. Any information would be helpful. Thank you.

File with your insurance, your deductible will be refunded, if they win the subrogation.

    2. You have three options.

File a claim with your collision coverage. You pay your deductible, and you get your car fixed. Your insurer will try to get that money back from the other party in subrogation. If they can get that money – which is not guaranteed – they’d refund your deductible.

File a claim with the other driver’s insurance. Hope they have valid coverage, and the insurer accepts liability. There are scenarios where they won’t cover things. If the other person was not listed on the policy. Or they didn’t pay their insurance bill. Or they lie and say you merged into them. But…..if we assume they have coverage and accept liability, they’d pay to fix your car, up to their policy limits.

Skip insurance and sue the other driver. This is your least desirable option, if you otherwise have insurance that would fully cover this.
