My mother was in an accident while working (contract delivery driver). A few days after the accident her insurance company emailed her and said she has no coverage because she was working in her personal vehicle and didn’t have commercial insurance.

    She had this same job for 30 years. Shes used the same in-person insurance agent then entire time. The agent knows she was working with her personal vehicle because she delivered to his business. They have covered prior accidents including a total loss just over a year ago. Now obviously from everything I’ve seen in the communication she’s received she did have the wrong insurance I’m not arguing that (and yea she should have known what she needed).

    Has anybody ever dealt with a situation like this? Does she have anything to go on? Maybe negligence by the agent?

    1. Unfortunately not a lot they will do. She didn’t have the correct commercial coverage. Hopefully the platform she was delivering for is providing liability coverage if she is found at fault for the loss.

      Was she working during the prior accidents mentioned?

    2. She could sue the agent. But how can she prove that they knew what she was doing with her vehicle?

    3. If it’s not covered by her policy, they won’t pay. No insurance company will ever let you know “hey you have the wrong policy”. Instead they will investigate and deny any claims outside of their policy. It is her responsibility for carrying the correct policy for her needs.

      My only thought would be if the agent removed the additional coverage to keep her policy premium lower. If that happened and she knew, it’s on her. If she didn’t know, it’s on the agent.

      That said it is the policyholder’s responsibility to ensure they’ve got the correct coverage in that situation so not sure there’s any options here.

      No personal auto policy will cover delivering persons or property for a fee. She might have been able to do it before Uber, Lyft, Door Dash, etc. became a huge thing but not anymore. Ultimately she’s responsible for knowing what the contract she signed covers.
