Downtown Charleston is a parking garage that a vehicle can barely squeeze out of in a sensitive area with pedestrians on the sidewalk. I was proceeding cautiously and responsibly, and the plastic gate came down on my truck, the metal bolts scratched my tailgate.

There’s a few scratches an inch or too long right down to the bare metal. I’m sure it will rust soon.

I sent photos to the company, but the first woman I spoke with mentioned filing a police report

Is this the best place to start? I’m hoping the company would just resolve it internally, but I either have to decide on contacting the police today, or my own insurance company. I guess they’ll tell me to file a report? My insurance is expensive enough I was hoping to avoid dealing with them.

    1. Use your insurance. You will not get anywhere with the parking garage and will end up waisting a lot of time.

Was the gate controlled electronically or was it stationary? Are there signs indicating a height restriction? Are there any signs posted about parking at your own risk, or other warnings about damage to vehicles/break-ins etc? Any security footage?

Police likely will not respond to private property for instances like this, and a police report wouldn’t add any value to the claim. Police reports are merely a record of what you told the officer in these situations. You could tell the police that a sasquatch took a dump on your roof and the twigs in the fecal matter scratched the paint…

I agree with others that say you’ll be wasting your time with the building owners.

Don’t call your insurance yet. Get an estimate and compare it to your deductible. Might not be worth making the claim.

Also consider getting touch-up paint and filling it in yourself.
