Hello, recently I had another car crash but my car while it was parked and luckily they stopped and police came so a report was filled out. The damage isn’t terrible it’s just in various places because of the angle it got hit. I went to get a quote because first the person that hit it said they would pay out of pocket to not get insurance involved which I’m fine. I got the quote and the guy ghosted me which is fine since I have his insurance info. I sent it to insurance and I said I want cash in stead of shop to compare what they offer. Offer comes back almost 40% lower than actual quote and they don’t want to pay the difference because they say that the only pay the difference to a shop and they want to make sure I fix the car. I ask them if there’s another shop of their preference that they want me to get a quote and they don’t answer. Are they allowed to do this how can I go about this or is there nothing I can do?

You can bring your car to their network shops for repair. You can usually find the list on the insurance website. It looks like you want cash instead.
Yes, they are allowed to do this. You are dealing with another person’s insurance company, not yours. And they have made you a settlement offer to resolve the claims you have against their insured. You know the terms of their offer – $X in cash or payment to the shop to repair the car. If you don’t want to accept their offer, you don’t have to. Your alternative is to sue their policyholder, win the case, obtain a final judgment and collect on that judgment. Once you’ve done that, you can do anything you’d like with the money you collect. Probably take a year or two and cost you more than the actual repair costs to go that route, but you’re within your rights to do so.
Just do what normal people do – take it to one of their networked shops and let them pay to get the car repaired (or take it to a shop you want to use and have them deal with the carrier). If you’d rather keep a smaller amount of cash instead of fixing your car, you know what your options are.
The thing is apparently I did. The quote is from the shop in network. They literally just said “we want to make sure you repair the car and we only pay over their estimate to a shop” I have friends that work with cars and the damage doesn’t affect drivability so I would rather just keep the difference
