Ok so I’m asking for a friend so she doesn’t want to post with her username, but I will outline what happened since I was with her…..

    Due to just careless driving, she turned around to get something from her purse in the backseat while driving and next thing we know, airbags are deployed and we hit the person in front of us. Thankfully we are all ok, she immediately begins gathering her paperwork (license, registration, insurance). She looks up her insurance on the app and notices that her coverage expired on March 8th, 2026 even though she was told the policy would rollover as it had in previous years.

    Fast forward to last night immediately after the accident, she notices her policy did in fact expire and she panics and furiously begins renewing coverage. Less than 5 mins later, policy is purchased and insurance is now active. Police show up, they write up their report, she showed them her insurance and they immediately ask her if she just purchased insurance now after the accident. Initially she says that she purchased it in the morning but they catch on, threaten her with jail and she explains the previous story to them. They end up writing her a $114 ticket for driving without insurance and they send us on our way and we all depart ways and leave the scene.

    So now she is just wondering what to do next, she has no idea where to even begin. Can she call her insurance company today (she tried last night a they were closed, told to call back during normal hours) and begin the claim process? Does she try and stand her ground with the timestamp on the email? Does she contact a lawyer for the potential legal issues? What can she expect to happen next? We just don’t even know where to start. Any and all advice is much appreciated. Sorry for the long post and if you need any other information I haven’t provided, please let me know! We really need your help! Thank you so much!

      Here are some more details that might help:

      She had just bought a new car on March 7th 2026 and when she called to update her policy with the new car information, she asks about renewing her policy which she knew expired the next day. She had been with this company for 2 years and the years prior, her coverage just rolled over with the autopay she had setup so she asked if the same thing would happen this time. The agent said yes it should rollover, but check in about a week to make sure.

      She has a verification email from the insurance company saying the policy was effective as of 10:30pm on April 12th and the accident didn’t happen until 10:58pm and police didn’t show up until 11:35pm…so she asks if that means she is covered. The police were highly annoyed and told her to stop playing games and again threaten her with jail for lying to a police officer. She wasn’t really playing games, she just wanted to know if the time mattered on the email.

      Accident likely won’t be covered and she’ll likely be charged for driving without insurance. Insurance companies time stamp everything for this reason and they’ll do a full investigation.

    3. So, what your friend did is something called insurance fraud.

      Insurance is something that by definition, must be purchased before you “need” it.

      Your friend lied to the insurer when renewing that policy and for that reason they will absolutely not pay any claims related to this accident.

      They will 100% investigate and figure out she is lying.

      She would do best to tell the truth and avoid further penalties.

      She did not have insurance coverage at the time of the accident. So unless she’s going to commit insurance fraud and lie about when she bought the insurance vs. when the accident happened….WHICH SHE’S ALREADY TRIED TO DO…..insurance will not cover this. So there is no insurance claim to file.

      The other driver can choose to file through their insurance coverage (if they have collision coverage). Their insurer will then come after your friend for reimbursement via subrogation. She can pay them back out of pocket for the claim. Or the other driver may sue your friend.

      As for your comments….you’re all over the place. You said at one point she didn’t try to renew her coverage until after the accident. Then in a comment, you say she had an email from her purchase at 10:30 and the accident happened at 10:58. Both of those cannot be true. It feels like you’re not being completely honest about the timeline of events here.

      If her insurance was expired when she got into the accident, she doesn’t have insurance for the accident and she shouldn’t try and file a claim. Buying insurance after you hit something is not how it works. It doesn’t matter when the police showed up.

    6. Not having insurance is the least of her issues right now. This is called insurance fraud

    7. She can begin the claim process, but based off what you said here, it sounds like she has no coverage for the loss since her insurance expired. She can get a lawyer if she wants, I am not sure what they would do to help her here.

      If she files a claim (or the other person does), then they will investigate. Anytime a loss is reported where a person either takes out a new policy, or renews with a gap in coverage right around the time an accident happens, they are going to be thoroughly investigated.

      As far as what she can expect, it depends if she is truthful or not. If she tries to say the accident happened after she renewed, then she should expect them to look into a lot of things, including but not limited to: Phone records, police camera footage, statements from all parties, and other information they feel is relevant.

      If she is honest and tells them that she was told by someone in the company should would be covered, then they would look internally to see if that is true and if that actually changes anything.

    8. She had no insurance, she should not file any claims. If she does, it will be flagged for special investigation and she will be instantly caught committing fraud because the police literally wrote her a ticket for driving without insurance.

      One more time in case it wasn’t clear above. Buying insurance and filing a claim after an accident already happened is fraud. Point, blank, period.

      Your friend is cooked.

      She’s not the first person to try this and definitely not going to be the last. The second that claim is reported, it’s getting flagged. Every adjuster has seen this a hundred times.

      The autopay excuse does not work. It’s her responsibility to verify that these payments are going through.

      Additionally, she likely answered some form of the question “have you been involved in a car accident since your coverage lapsed?” With a “no”. That’s material misrepresentation and insurance fraud. Tell her to be smart about it. This can absolutely follow her if she messes around.

      Start by not making any fraudulent representations. Like she tried with the police.

      Time for a quick consult with an attorney— can your friend rely on communication from her insurer that her coverage was in place and active immediately prior to the accident.
