Hi guys so I just rear ended Someone on the freeway and I didn’t want to get my insurance involved because I just got my car and my insurance is already high enough. I offered the guy 1000$ dollars to not get the insurance involved and he agreed. I have the accident on dash cam. We then went to a bank so I can get the money. I recorded him account the money, counting it, and putting it in his back pocket. We also shook hands. I got all that in video and also the date, time, plate number, license, photo of him and pictures of the accident. So my question is should I be concerned about him still involving insurance?

Yes. Yes you should. He has not waived any of his rights of recovery, nor have you protected yourself from liability.
Consider it a $1000 gift. Maybe he won’t take it any further, but I wouldn’t bet on it.
The next question for you to ascertain is whether your insurance carrier can deny liability of you willfully conceal the occurrence from them.
Time to read your policy.

Technically you should have him sign a “release of liability” because they still have a right to contact your insurance or sue in case they experience further undiscovered damage or develop “symptoms” of injury.
If they are a good person they would not do this because you had a handshake agreement. But if they are a bad person they will take your money and then pursue your insurance further.

If he doesn’t have your insurance information then you’re probably okay unless they find hidden damage on his car in excess of $1K to repair then he might come back for more since I’m not sure those handshake cash agreements are legally binding as settlement in full.

I was rear ended by a high school student once. We pulled over and I jumped out all mad looking. She instantly burst into tears. Made me feel bad.
We looked over my bumper, and hers. Just a couple scratches on my old car. Got her info, she even gave me her parent’s numbers.
I told her that it’s fine, don’t worry. Get to class. Made her cry even harder. 😄

I did this when younger, they did file a claim, State Farm never informed me. I found later when I had a larger accident and thought I had their claim free forgiveness.
There is no law, rule, or regulation that says you two can’t settle this amongst yourselves. But $1000 for a bumper is very reasonable these days. And once he accepted your money, it’s a done deal. He can’t get paid twice!
When I did this, I had its all in writing. Did a text conversation that stated the agreement, then met up with him again and had the guy sign a waiver or release of liability and stated the terms of agreement. I printed 2 copies, we both signed both, and we both kept a copy. To be honest even after we did that. I was still concerned he might still go to my insurance.
If you have his contact information, just give him a call or send him a text that says that you received advice and would like to have something signed regarding the exchange and see if you can both sign it.
