I tore my hip labrum in a car accident where I was rear ended very hard. I had surgery in December, and did physical therapy after for about 6 weeks. I was cleaning off my car after a snow storm at the end of January and my foot slipped on the snow and it felt like I pulled a muscle in my thigh (like my hip abductor maybe?) and my next session of PT I told the PT it felt like I pulled a muscle so we worked specifically on that. I got sick the next week and then we had 2 more big storms so I basically stopped going to PT. The pulled muscle feeling got worse so I made an appt to see my ortho surgeon. He went out on paternity so the appt got pushed back and finally I was struggling to even get my pants on so I said I need to come in and atleast see a PA because I’m worried I retore the labrum. They ordered a new MRI, I did indeed tear the anchor they put in out and the surgeon said it’s important to have a revision since the anchor is now floating around in my hip joint. So they are working on getting a revision surgery approved.
Is the second surgery considered part of the bodily injury claim? State is NJ. $250k bodily injury limit, I had $50k PIP but my health insurance has been covering things for a bit, and said the will not subrogate. I’m not sharing this to ask for an amount estimate or anything just sharing since I’m wondering how it will be covered health insurance wise and if will be considered my ow injury or part of the car accident. I had the other side repaired as well and did perfectly fine and it healed great!
If you re-injure a car accident injury after surgery, does it count in your bodily injury claim?
