I'm in a very messy family situation with my mom and need some general info to make informed and legal decisions.

Without going into all the details, my mom gave me her car last month and we titled, registered, and insured with us in New Mexico. Her move to NM is delayed until June, maybe longer and she is now wanting the car back to get around in the meantime. I was originally thinking to just have her use it, but since it's a decent amount of time I'm worried about her getting in an accident with it on my insurance. We just paid for a 2 year registration so I'm wondering if we can give her the car and have her provide insured while keeping it registered in our name.

I really don't understand the ins and outs of insurance. Additionally I'm too mentally and emotionally drained from dealing with my mom to try researching the risks and options. I'm hoping someone can explain the risks and best options to me in simple terms…

Car being used out of state by family member.

    1. Technically, she has to be put onto the insurance regardless if she’ll be living with you, or using it in any way

At minimum State Farm changed their policy to where you can’t have permissive drivers anymore, they have to have their drivers license registered on the insurance

If you send the car back to where she’s living, and there’s already issues… I wouldn’t count on her actually going to move to NM… but that’s your family issue just my speculations
