Asking about settlement for the party who is 100% not at fault. At fault's insurance company has accepted full responsibility for accident.

If medical bills total $20,000 and medicare only paid $5,000 which figure is used in the final settlement calculation? Keep in mind that the medical providers who take medicare agree to accept the lower price and the difference is not paid by or billed to the patient.

Will the medical providers(hospital, ER, ambulance, etc.) be reimbursed for the difference(between medicare payment and billed amount) by the at fault party's liability insurance?

    ETA: Location is Connecticut

How are medical bills calculated in auto accident settlement.

    1. This depends a lot on the location this happened in. There are plenty of places where they would only use the $5K, which is honestly the way it should be.

    2. This varies a lot based on state law. If Medicare paid for your bills, they will submit a lien to the auto insurance company to be reimbursed.

In my state, you would get $0 consideration because you don’t owe anything for the bills. We would still offer something to reach a settlement, but technically under the law here (FL) you are only entitled to your actual out of pocket costs unless you prove a permanent injury.
