Hi everyone. I'm about to sell a one bedroom co-op in NYC. I lived there just for one year. I had two dogs that kept waking up in the middle of the night and zooming. I put down area rugs, but my downstairs neighbor would still bang at my ceiling. They called 311 on me once, and cops arrived at my door. Afterwards, I knocked on the neighbor's door, smiled, and tried to start a conversation. They were convinced that I was related to the previous owner (there is a resemblance, and I look like a teenager with an old face, so perhaps I appeared too young to buy on my own). Apparently, they had issues with the previous owner making noise.
I wrote to the co-op board and management company to help mediate this issue. It didn't get very far, as the neighbor refused to respond to them.
Now I'm looking to sell. My goal in life is to foster animals and I realize that I need to live on a ground floor. I received an offer. Buyer's lawyer asks if I had made written complaints about conduct/noise that affects the unit. Do I have to disclose the personal issues that I've had with the downstairs neighbor? Buyer is single and without pets, so I figure they'll get along with the downstairs neighbor. I'm afraid the offer will be retracted if I mention any neighbor issue. What sort of language should I develop to explain that it's a personal issue, not a noise/conduct issue that will affect the unit? Thanks!

You didn’t make the complaint, your downstairs neighbor did. Seems like if the question was written as you wrote it here, you can say no.
