Looking for some insight from adjusters or anyone experienced with uninsured motorist (UM) claims, especially in Minnesota.

    I was rear-ended at ~45 mph by an uninsured driver (not at fault) about 5 weeks ago. I sustained a diagnosed concussion and cervical strain. I went to urgent care the same day, followed up with my PCP, and had a concussion-focused OT visit. Symptoms lasted several weeks and included headaches, nausea, dizziness, light/noise sensitivity, brain fog, difficulty concentrating, irritability, fatigue, and neck pain.

    Most symptoms have improved, but I still have some lingering issues (mild brain fog, occasional difficulty concentrating, and neck stiffness/limited rotation).

    Here’s where I’m confused:

    My medical bills for “active treatment” don’t meet Minnesota’s $4,000 threshold, and the adjuster has pointed that out. However, they’ve still acknowledged injury and inconvenience and have made offers:

    Initial offer: $830

    Increased to: $1,300 after I submitted a demand

    So clearly there’s still some value being assigned even without meeting threshold.

    I submitted a demand at $10,500 (expecting to negotiate down), and I’m now planning to counter around $5,500.

    My questions:

    If I truly don’t meet the threshold, why are they still increasing the offer? Is this just standard “nuisance value” or is there still legitimate settlement value here?

    What would be a realistic settlement range for a concussion with ~4–5 weeks of symptoms but no missed work?

    Is continuing to negotiate in writing the right move, or should I take a call to potentially move the number more?

    I’m not expecting a huge payout here, but I also don’t want to leave money on the table. Honestly, I’d feel like ~$3K would be a fair resolution given the duration and impact.

    Appreciate any insight from those who’ve been on either side of this.
