Facts
- Bought furniture on FB Marketplace
- Furniture fit in cargo area, but the dolly to move it down the stairs only fit in passenger seat.
- Deceleration to get in my driveway caused the dolly to flip forward and break windshield.
- Insurance company gives estimate to fix with their vendor including the comprehensive deductible being taken out.
- My preferred vendor (on my behalf) pushes back on the estimate for a variety of reasons (car needs safety system recalibration, etc).
- Insurance company comes back says they'll approve the increase estimate as a "one-time exception" but has reclassified to a collision.
My Question
- Is this legit? I would think there are some rules to these classifications and given volume even industry standards beyond the rules.
- Can I make them go back to their original estimate given they already had committed to comprehensive before I pushed back.
- If they upgrade to collision, that impacts premiums and driving record, no?
Here is the language they sent me:
Collision coverage
"Physical damage to the vehicle caused by collision or upset is covered, regardless of fault, subject to the deductible stated in the Declarations and the other terms, conditions, and exclusions of the policy."
Comprehensive (Other Than Collision) coverage
"Physical damage to the vehicle, caused by anything other than by collision or upset is covered, subject to the other terms, conditions and exclusions of the policy."
Insurance Company Reclassifies from Comp to Collision?

If they are only changing it because of the calibration, that seems questionable.
I would read your policy language to see. Comp usually includes only glass damage. Some policies might say that if the glass damage is caused by something covered under collision, you can choose to have it under collision. Some might not. Read what your policy says.
A shifting load accident is collision, not comp. It is an at fault accident for failing to secure the load.
I would check your policy language.
Collision is impact with another vehicle or object.
Other than collision (comp) includes glass breakage but if glass breakage is caused by collision, you may elect to have the loss considered under collision.
It sounds like they are considering the dolly’s impact with your windshield as collision.
Was the damage caused by the collision of the dolly with the windshield? The vehicle was in motion, and collided with something. That the something was inside of it and not outside does not make it not a collision.
