I got rear ended in the company vehicle a few weeks ago. Workers comp is paying for my time off and treatment. Other drivers insurance contacted me this morning that they are still investigating the claim.

    I asked my workers comp agent handling my claim and said that I can get a settlement from the other drivers insurance but that they can’t represent me. Should I get an attorney for this or try to tackle this on my own? My back is has been sore with some sharp pains that come and go. The doctor told me to rest for another 2 weeks and to come back for a check up after.

      I can only speak to my own experience, but documentation and ongoing treatment are huge factors in a settlement.
      If I just had soreness and sought no other/minimal treatment I wouldn’t hire an attorney. They’ll take a third of whatever your settlement is.

      I hired one once my injuries were ongoing for over two months with minimal progress, ongoing weekly appointments, ongoing imaging and ongoing FMLA time. Now I’m glad I did almost five months post accident.
