My husband got into an accident a couple of weeks ago, and when the police report came out it has the driver insured. However, our adjuster let us know they in fact do not have an active policy. Anyways, I just got an email from USAA stating that the other driver and the passenger got a personal injury lawyer… is this common for someone without insurance to do? Anything I should be worried about?

      It’s not uncommon for a person to hire an injury lawyer if they were hurt in a not-at-fault accident, if that’s what you’re asking. It would be less common for an at fault driver to hire a personal injury lawyer.

      I mean, you don’t say where you’re at, and location can matter. You don’t say whether or not your husband was at fault in this accident. But if the scenario is that he’s at fault and the other person has injuries from the accident, it would not be unusual for them to hire a lawyer. Your insurance carrier would have a duty to defend you regardless. Just refer it all to them and let them handle it.
