hello all,
    i was involved in a car accident last summer which i was found at fault for. there were three injured parties which all agreed to settle in November.

    i thought everything was done with until i received a letter in the mail from my insurance telling me they have made an offer of settlement to someone (who i never heard of, nor were they mentioned on the claim). i didn’t think anything of it until i received another letter stating one of the injured parties was looking for another settlement which the insurance has also made an offer for.

    i don’t understand how this is possible? especially since i thought the settlement meeting in November meant once they received their settlement and signed all the documents it would mean the claim would be closed and done with. how can this person who was not listed on the original claim ask my insurance for a settlement and how can the injured party who already agreed to settle to a certain amount seek additional compensation?

    i guess it just irritates me because it appears my insurance is going to give it to them even though I consider it greed and I’m just tired of reliving this nightmare.

      You need to talk to your insurance adjuster to get clarification here.

      The one person could have been a passenger in the car who was hurt, and it just took them longer to submit their injury claim. Or are you alleging that this person was not in the other car for the accident?

      As for the person who took some initial settlement and is asking for more….who knows? Did your insurer get this person to sign a release of liability on the first settlement? Or did they not get a release? Is this person asking for more b/c they’ve subsequently run up more in medical expenses? Are they asking for pain and suffering?

      So without knowing more, it’s impossible to answer. You can feel that it’s “greed” all day long. Maybe it is. Maybe it isn’t. Maybe they were legitimately hurt by you and they deserve to be compensated for the injuries that you caused them. Or maybe they are scamming the system. Call your adjuster and get clarification from them.

      New claimant has nothing to do with others. What the others did with your insurance doesn’t mean the new claimant has any less rights. Think about what you’re trying to be upset about. You hurt a bunch of people. One was slower to take legal action so you think they shouldn’t be included or they for some reason should have been required to join the other claimants? The door doesn’t close on other injured people but because some people have settled their portion of the claim.
