Other driver hit me. I have Dash Cam footage to show she is at fault. Clear enough that my insurance denied her claim against my insurance within 48 hours. However, other driver is not responding/cooperating and therefore her insurance has not accepted liability. It's been 3 weeks.
My insurance is Progressive and I am in TX.
If I go through my own insurance, how likely is it that subrogation will be successful? If unsuccessful, are my rates likely to increase significantly? I assume this counts against Progressive's "accident forgiveness?"
Is it better to wait for her insurance to deny liability then proceed with repairs under uninsured motorist vs collision? Does this get switched if I file under collision and then they deny? Does it make a difference?
The damage isn't that bad but it's there and it's a 3 month old vehicle. I want to do what's cheapest in the end but for a 3 month old vehicle, I also want it looking brand new again.

Use your insurance. No one can say if subro will be successful. Depends what may be going on with their insurance.
Their insurance would need to deny coverage, not liability, to use uninsured motorist. They can switch coverage later if needed. You can ask progressive about the accident forgiveness.
