Ok so here is the situation. This all occurred in Georgia for reference. I’ll try to keep it brief. I’m trying to help a friend who is young and hasn’t dealt with insurance before. I am not that experienced either. Accident happened in beginning of December 25. Police didn’t fault anyone. My friend has State Farm, the other driver has Farmers. My friend did go to the hospital on his own accord a few hours after accident and has some relatively low medical expenses. Accident was reported to the other drivers company first and then he was advised to contact his company. Both companies were contacted, I guess, because police didn’t determine who was at fault. State Farm told my friend he could accept claim payout from them or he could decline their payout and keep seeking payout from Farmers.

    His vehicle was sitting at the impound lot airbags deployed until mid March. Farmers told him he was responsible for payment to impound lot. He was never made aware that he needed to get the totaled vehicle out of impound (again young and inexperienced). After many calls with Farmers and getting no where he asked State Farm and they agreed to pay that and said they would seek repayment from Farmers for that $3800ish amount. Farmers is still saying that they are conducting an internal investigation and the are waiting on body cam footage from the police dept. It’s been 6 months. Farmers is impossible to talk to on the phone. Every time he tries to escalate the call to a supervisor his person won’t escalate it. It’s always the same response. Still under investigation. State Farm concluded their investigation stating it was clear to them based on police report, location of damages and police diagram that the other person was at fault.

    So 6 months have passed. He is paying 2 car payments because he is paying on the totaled one and the new replacement vehicle. He was not able to get a rental because he is 20 years old. Obviously a younger student is struggling to keep it all paid. State Farm just offered $29k for his vehicle. The proposed retail value at the time of the accident was $38k. State Farm has removed $500 for the deductible from that amount. Farmers is still saying they are conducting an investigation. He is obviously anxious to try and get the totaled vehicle paid off so he is back to only one car payment. Before he accepted the payment from State Farm here are the questions we have.

    1. Did he make a mistake by getting State Farm involved?
    2. Should he accept payment from State Farm and forget about Farmers?
    3. If he accepts State Farm payment can he challenge the value? What documentation is needed?
    4. What about medical expenses, who is responsible? How would we go about handling that?
    5. Does he have a right to challenge Farmers based on the time frame and the fact they seem to be stalled out on investigating? How can we speed it up?
    6. Basically what directions should I give him to make sure he doesn’t get screwed and this gets settled as soon as possible. He isn’t trying to sue or anything. Just looking to get true value for his totaled vehicle and his medical expenses covered.

      If he has collision, going through state farm would have resolved this months ago. Waiting Farmers out is making this infinitely more expensive and painful.
