Just wondering if I use my rental coverage for an auto accident that I was not at fault in do I have to fix through my insurance and pay deductible then wait for reimbursements ?

    My rental coverage is $30 per day for 30 days or until repairs are done.

    I was hit by a driver trying to avoid another accident and now that driver’s insurance is stalling trying to pin shared liability with the other “unknown” driver that made the driver that hit me swerve into me while I was at a light waiting for my turn. So now my car is damaged and the wheel makes a sound I don’t want to drive on it. It is parked in my garage. I have rental coverage but it isn’t enough for an equivalent mid size SUV. I need an SUV for my work equipment so I would be paying the difference out of pocket if I go through my insurance which is $500 for a month and if I fix through my insurance I will have to pay the deductible which is $500 or $1000 I will have to check and wait to be reimbursed. I am not working this week due to being injured but next week I have to work. It seems like them determining liability may take some time.

    My question is if I pay the rental car difference am I stuck with paying up front the deductible to fix my car through my insurance until the at fault drivers claim liability?

    If I use my car insurance for a rental do I have to fix through them?

      Couple things:

      Did the other 2 vehicles actually make contact with each other? If they did not, and your vehicle was stationary, this is 100% their driver’s fault. If they DID make contact prior to your car getting hit, then there is potential for shared liability.

      For using your own coverage, in a situation like this, I’d recommend it. You’ll get a rental while your car is getting fixed, and yes you’ll have to pay the $500 deductible. Your insurance will subrogate against the other driver’s insurance (and potentially the 3rd vehicle’s insurance, if they can be identified), and they’ll attempt to r cover your deductible if they can. That part will take a long time.

      Was there a police report? Also, what state did this happen in?
