I’m a 23M. My car was totaled after I was rear ended by drunk driver. He was arrested on the spot and was taken to jail. I’m from California and CHP handled my case and I was told I was able to get his info and all of that online within 8 business days. The only reason I know he doesn’t have insurance is because I overheard him telling the officer “I don’t have insurance I just bought the car 5 days ago” so now I’m stressed out about these lawyers calling me trying to get me to work with them. I recently started working with a bodily injury lawyer but I’m hearing mixed things about these guys. My main injuries are just my knee and my neck which I’ve already gone to the hospital for. But now they’re talking about sending me to chiropractor and what not. I know the guy he’s a mutual friend but I’m still not sure what to do I’m so stressed out. Should I just stop working with them and see what the payout is from my insurance? Any advice would be greatly appreciated.

California likely has “uninsured motorist” coverage as part of what you pay for in your own insurance (here in OR, that’s how it works). UI in OR pays up to $100k for medical and other expenses. After medical costs, pain and suffering can be covered too.
If the other driver has no assets, a lawyer has nothing to go after, so you might be better off just pursuing this yourself.
I don’t put down injury attorneys 100% of the time, because sometimes they really can help people. But given that the guy admitted to being uninsured, the attorney isn’t going to be able to help you in the long run. At this point, they’d just be trying to milk as much additional treatment out of you to maximize their own payout from your insurance. If you have severe/significant/life-altering injuries, it may be worth it, but that’s your own discretion.
I would not recommend pursuing with an attorney. Just work with your own insurance for your vehicle repairs and medical payments. Your insurance will pursue the other driver for any assets or source of recovery that the other driver has.
I’m sorry that this happened to you, because it usually doesn’t turn out well. Good luck with everything.
