So I’m not looking for a 50k payout. It was a minor-ish accident (I was going 20mph on a single lane road, other party didn’t yield and made a left turn out of a right hand parallel parking spot into the passenger side of my car, they dinged my car pretty good because I had to get it towed but it looks fine-ish like I couldn’t drive it because my bumper was sitting weirdly on the front passenger side tire).

    The bodily claim adjuster sent me an email saying this:

    For your injury claim, I will be handling this portion of your claim.  Can you advise if you are seeking additional treatment for your injuries, at this time?  As you were injured in a motor vehicle accident that our insured was liable for, you will be eligible for a bodily injury claim as well.  This claim would include all relevant & necessary medical treatment/billing, missed wages/work due to your injuries, out of pocket expenses for medication/durable medical equipment/etc. as well as compensation for your pain/suffering & inconvenience.  Please note however that this portion of your claim would not pay out until you were ready for settlement – which typically occurs when you have concluded treatment & have recovered from your injuries.

    I had a concussion, neck and back pain. I feel fine, I just don’t want to get royally low balled because being out of a car really inconvenienced me. Should I continue treatment and let the adjuster now or should I just say I’m not continuing treatment because symptoms have subsided?

    Update: At Fault Party Accepted Liability, Car is in process of being fixed or totaled out (not sure if it’s being totaled, hope not cause I love my car) but unsure how to respond to this email for bodily claim?

Continue to treat until you know your concussion symptoms have fully subsided and don’t reoccur but also make yourself aware of what concussion symptoms look like and how your friends/family are able to observe them best. Go see a neurologist. Tell the adjuster you’re still treating and will provide records/bills when treatment has finished. You will get lowballed unless the case is worked up properly.

      stop trying to milk injury for perceived property losses

      get the treatment you need and continue treatment until you are well and let them know when that is
