Yesterday, I was waiting for an opportunity to enter a roundabout when a truck hit me from behind and pushed me into the roundabout, pushing my car about ten feet. I think he might have been stopped prior to hitting me, either way he wasn’t going very fast. It damaged my bumper and scraped up the trunk. The police came and did a report, I collected his insurance information, and I made a report (but didn’t file a claim) with my insurance. The police and insurance both asked if I was injured and I told them I was not aware of any injuries at that time. My insurance said I could file with them and they’d go after the other guy’s insurance, or I could file with the other guy’s insurance. I have not made a report yet with the other guy’s insurance. Today I woke up with a sore back and shoulders, sort of how I feel after riding a rickety roller coaster.

    Having never been in this situation, I am not entirely sure what I should do. Do I file the claim without knowing if I’m injured, and then go to the doctor? Go to the doctor to see if I’m injured and then file the claim? Should I pay for things out of pocket to file with the car insurance or let my health insurance go after the car insurance later?

    I was lightly rear-ended yesterday and am a bit sore today. What is the order of operations on what I should do?

      You can file the claim now and seek treatment. Definitely don’t delay treatment if you feel you need it. The bills and stuff can all get settled later on. 

      I’d probably file with the other guy’s insurance first. It’s simple liability and it doesn’t sound like they’re trying to dodge their repeatability at all. If things start dragging there, you can always just use your own policy for Med Pay/PIP if you have it too.

      If you need treatment get it. I’m an ex bodily injury rep handled litigation for years retired with 37 years exp. But if you wait more than about 7 days to get treated it will look strange and be harder to get taken seriously.
