I’m handling my own uninsured motorist claim through my insurance after being injured as a passenger in a crash caused by my uninsured ex.
Facts:
– Kentucky claim
– UM bodily injury limit: $25k
– Fracture confirmed on CT
– Diagnosed with radiculopathy and currently in PT
– About $56k+ in medical bills so far
– Out of work for about 2.5 months from USPS job
– PIP already paid about $7,800 medical + around $2,200 wage loss
– Police report/ ER report states that I was the passenger
– We don’t live together
My question is:
Since PIP already paid part of my wage loss and medical, can I still pursue the remaining wage loss + pain and suffering under the UM bodily injury portion?
Also, with objective imaging + fracture + work loss, is this the type of claim where carriers usually consider tendering limits once treatment stabilizes?
Not asking for legal advice, just trying to understand how adjusters generally evaluate Kentucky UM claims like this.
